These Terms of Service govern access to and use of the Mosswhisper website, online store, content, features, products, and related services, collectively referred to as the “Services.”

Mosswhisper is operated by WANG KWONG HK TRADING LIMITED. Our store is hosted on Shopify.

By using the Services or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree, do not use the Services.

Eligibility and Accounts

You must be at least the age of majority where you live to make a purchase. You agree to provide accurate, current information and protect any account credentials.

You are responsible for activity conducted through your account.

Products and Information

We aim to describe products accurately, including vessel dimensions, wax type, fragrance notes, approximate burn time, color, and intended use.

Screen settings, lighting, fragrance perception, natural materials, and production tolerances can cause minor differences. Images and scent descriptions are illustrative and do not guarantee an identical appearance or fragrance experience.

Customers are responsible for reviewing product details, ingredients or allergen information where provided, warning labels, care instructions, vessel dimensions, and intended use before purchase and use.

Candle Safety and Use

Before lighting, place the candle on a stable, heat-resistant surface away from drafts, vibrations, children, pets, fabrics, paper, decorations, and other flammable materials.

Keep a burning candle in sight, follow the product label, and use an appropriate tool to extinguish the flame.

Never leave a burning candle unattended or move it while the wax is liquid. Keep the wick trimmed as directed, do not burn longer than the stated maximum time, and stop use if the vessel is cracked, chipped, excessively hot, or otherwise unsafe.

Mosswhisper is not responsible for damage caused by misuse or failure to follow product warnings, except where responsibility cannot be excluded by law.

Availability and Pricing

Products, prices, promotions, and availability may change without notice. We may correct errors, limit quantities, or discontinue products where permitted by law.

Taxes, shipping, customs duties, and other charges are shown or handled as described at checkout and in our policies.

Orders

Submitting an order is an offer to purchase. We may accept, reject, or cancel an order for reasons including payment failure, suspected fraud, inventory errors, incorrect pricing, address problems, or legal restrictions.

If a paid order is canceled, we will issue an appropriate refund.

Payments

You authorize the selected payment provider to charge the amount displayed at checkout and confirm that you are authorized to use the payment method.

Shipping Returns and Cancellations

Shipping is governed by the Shipping Policy. Returns, refunds, and eligible pre-shipment cancellation requests are governed by the Returns and Refunds Policy.

These policies form part of these Terms.

Promotions and Discount Codes

Promotions may have separate eligibility requirements, dates, product exclusions, quantity limits, and redemption instructions.

Unless stated otherwise, one discount code may be used per order, discounts cannot be applied after purchase, and offers cannot be combined. We may correct or cancel a promotion that contains an obvious error where permitted by law.

Electronic Communications

When you use the Services or contact us electronically, you consent to receive order confirmations, receipts, shipping notices, policy updates, and other service communications electronically.

You are responsible for providing a working email address and reviewing spam or filtering settings. Marketing communications are subject to the choices described in our Privacy Policy.

Acceptable Use

You may not misuse the Services. Prohibited activities include:

Violating applicable laws.
Interfering with website security.
Introducing malware or harmful code.
Scraping or harvesting data without permission.
Impersonating another person.
Submitting fraudulent information.
Infringing intellectual-property rights.
Sending spam or using the Services to harm others.

Intellectual Property

The Services and their content, including text, images, graphics, product presentation, logos, trademarks, and layout, are owned by Mosswhisper, our affiliates, or licensors and are protected by applicable intellectual-property laws.

You may use the Services only for personal, noncommercial shopping purposes unless we authorize otherwise in writing.

Reviews Feedback and Submissions

If you submit a review, suggestion, photo, or other content, you confirm that you have the right to provide it and that it is not unlawful, misleading, abusive, or infringing.

You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission for lawful business purposes, subject to our Privacy Policy.

User Content Standards

Reviews, photographs, questions, and other submissions must be truthful, relevant, and lawful. They must not contain confidential information, malicious code, impersonation, harassment, unlawful advertising, or material that violates another person’s intellectual-property, privacy, or publicity rights.

We may moderate or remove content where permitted, but we are not required to publish every submission.

Shopify Platform Notice

Shopify supplies the ecommerce platform used to operate the storefront. Products are sold by Mosswhisper, operated by WANG KWONG HK TRADING LIMITED, and not by Shopify.

Questions about products, fulfillment, returns, or customer service must be directed to Mosswhisper. Shopify’s own terms and privacy notices apply to its processing and platform services.

Third-Party Services

The Services may contain links, apps, payment tools, or integrations provided by third parties. Their terms and privacy practices apply to their services.

We do not control and are not responsible for third-party content or performance.

Disclaimers

To the maximum extent permitted by law, the Services and products are provided on an “as-is” and “as-available” basis.

We do not guarantee uninterrupted access, error-free content, or that a fragrance will match every individual preference. Statutory warranties and consumer rights that cannot be excluded remain in effect.

Limitation of Liability

To the fullest extent permitted by law, Mosswhisper and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services or products.

Where liability cannot be excluded, it is limited to the maximum extent allowed by law.

Product Warranties and Consumer Rights

Any product-specific warranty expressly stated on a product page or in product documentation applies according to its terms.

Nothing in these Terms excludes a statutory guarantee, warranty, remedy, or consumer right that cannot lawfully be excluded.

Events Beyond Reasonable Control

We are not responsible for delay or failure caused by events beyond reasonable control, including carrier disruption, customs action, severe weather, natural disaster, labor interruption, utility or network failure, government action, public-health events, or supplier interruption.

We will make reasonable efforts to communicate material effects and resume performance when practical.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Mosswhisper and its service providers from claims, liabilities, losses, and reasonable costs arising from your unlawful misuse of the Services, breach of these Terms, or violation of another person’s rights.

Termination

We may suspend or terminate access where permitted by law if we reasonably believe these Terms have been violated or the Services are being misused.

Provisions that by their nature should survive termination will remain in effect.

Severability

If a provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the Terms. The remaining provisions will continue in effect.

No Waiver

A delay or failure to enforce a provision does not waive our right to enforce it later. A waiver is effective only when clearly stated in writing by an authorized representative.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign these Terms as part of a merger, reorganization, sale of assets, or transfer to an affiliate or successor, subject to applicable law.

Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Returns and Refunds Policy, Payment Option page, and other policies expressly referenced at checkout, form the agreement governing the Services.

Governing Law

These Terms are governed by the laws applicable to the location of the business operator, without limiting any mandatory consumer rights that apply in your place of residence.

Courts with lawful jurisdiction may hear disputes.

Changes

We may update these Terms by posting a revised version. Continued use after the effective date means you accept the updated Terms, except where additional consent is required by law.
